Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Vibe Code Guild website at vibecodeguild.com and all related services, including learning cohorts, digital books, and community platforms (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

You must be at least 18 years of age to use the Services or enroll in a cohort. By using the Services, you represent and warrant that you meet this age requirement. If you are under 18, you may only use the Services with the involvement of a parent or legal guardian who agrees to be bound by these Terms.

2. Account Responsibilities

If you create an account or enroll in a cohort, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Cohort Enrollment and Payments

  • Enrollment: Enrollment in learning cohorts is subject to availability. We reserve the right to limit enrollment and to cancel or reschedule cohorts at our discretion.
  • Pricing: All prices are listed in U.S. dollars and are subject to change. The price at the time of your enrollment is the price you will be charged.
  • Refund Policy: If you are unsatisfied with a cohort, you may request a refund within 7 days of the cohort start date. Refund requests made after 7 days will be reviewed on a case-by-case basis. To request a refund, contact us at shane@vibecodeguild.com.
  • Payment Processing: Payments are processed by third-party payment processors. By making a purchase, you agree to the payment processor's terms of service.

4. Digital Products

Books and other digital products sold through third-party platforms (such as Amazon) are subject to those platforms' terms of service and refund policies. We are not responsible for issues related to purchases made on third-party platforms.

5. Community Guidelines

When participating in our community (including Skool and any other platforms we use), you agree to:

  • Treat all members with respect and kindness, regardless of their experience level.
  • Not engage in harassment, bullying, hate speech, or any form of elitism or gatekeeping.
  • Not share harmful, illegal, or misleading content.
  • Not spam, solicit, or promote unrelated products or services without permission.
  • Respect the intellectual property of others.

We reserve the right to remove any member from our community at any time, for any reason, including violation of these guidelines. We have a zero-tolerance policy for elitism, bullying, or making others feel unwelcome.

6. Intellectual Property

All content on this website, including text, graphics, logos, images, course materials, blog posts, and software, is the property of Vibe Code Guild or its content creators and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use our content without prior written permission, except for personal, non-commercial use as intended by the Services.

7. User-Generated Content

If you submit content to our community, blog comments, or other areas of the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with operating and promoting the Services. You retain ownership of your content.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that participation in a cohort will result in any specific outcome, including employment, revenue, or proficiency in any particular technology. Results depend on individual effort, experience, and other factors beyond our control.

9. Limitation of Liability

To the fullest extent permitted by law, Vibe Code Guild, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vibe Code Guild and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Services or your violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
